On August 5,1976, plaintiff-appellant, Ohio Fair Plan Underwriting Association (an insurance company), hereinafter referred to as appellant, commenced this action by filing a complaint in the Cuyahoga County Common Pleas Court against defendant-appellee Joseph Arcara, hereinafter referred to as appellee. Appellant’s complaint was subsequently amended to add as a new party defendantappellee Anthony Arcara, hereinafter also referred to as appellee.
