In a suit originally commenced in the justice’s court for $299, and afterwards appealed to the superior court, the appellant obtained judgment in the latter court against the Pair Oaks School District in San Joaquin County for fifty-five dollars and costs taxed 'at $134.50. The trustees of said school district offered to pay the fifty-five dollars, but refused to pay the costs.
