This is an appeal from a judgment of the superior court of the county of Sacramento denying appellant's application for a writ of mandate.
The events leading to the institution of this proceeding may be chronologically recorded as follows: Harry J. Gray, the appellant herein, commenced an action in the year 1921. against one P. L. Yarbrough to recover certain secret profits alleged to have been fraudulently earned by the latter while acting as Gray’s agent in the consummation of a real estate transaction.
