ORDER AND OPINION
FRIEDMAN, District Judge.
On Thursday, September 12, 2002, the court heard oral argument with respect to defendant eBay’s Motion to Amend its Answer to Conform to Proof and Include an Inequitable Conduct Affirmative Defense. At the close of the hearing, the court ordered the defendant to provide a draft Amended Answer to the plaintiff for review. Accordingly, the defendant filed its Amended Answer on September 17, 2002.
