WALSH, Justice:
The defendant, Larry D. Ray (“Ray”), was convicted, following a jury trial in the Superior Court, of Unlawful Sexual Penetration in the Second Degree. Post-trial, the Court directed a judgment of acquittal on the charge of Unlawful Sexual Penetration in the Second Degree but permitted the guilty verdict to stand on the lesser included offense of Unlawful Sexual Contact in the Second Degree.
