OPINION OF THE COURT
O’Connor, J.
The issue to be resolved at bar is whether the record contains substantial evidence to support a determination of the Suffolk County Department of Health Services Board of Review denying petitioners’ application for a waiver of a State Sanitary Code *42provision that requires enclosure of interior staircases in temporary residences for fire protection purposes. We conclude that it does not.
