On December 21, 1987, the defendant, Jason Ladone, was convicted by jury verdict of manslaughter in the second de*270gree and assault in the first degree in the "Howard Beach incident”. He was sentenced by this court on February 11, 1988 to consecutive sentences of 2Vi to 7Vi years and committed forthwith to the custody of the State Department of Correctional Services.
