Petitioner, City of California City (hereinafter the City) has sought to have a decision of a Workers’ Compensation Appeals Board (hereinafter the Board) vacated. The Board denied City’s petition for reconsideration of an award of benefits under Labor Code section 4850 to respondent Bobby Finklea (hereinafter respondent). Petitioner contends the award of benefits under section 4850, which provides for a leave of absence in lieu of temporary disability payments, 1 was improper here for the following reasons: (1) respondent was not an employee covered by the section because…
