Plaintiff in error was convicted of kidnapping; and his punishment assessed at imprisonment in the penitentiary for one year. Assignments of1 error which challenge the sufficiency of the evidence present the question of whether the act of the father tailing* his children from custody of the mother, under the circumstances shown by the record, constitutes the crime of kidnapping' under the statute, section 6465 of Shannon’s Code, which provides:
