Riner, Justice.

The Holland Furnace Company brought a replevin action in the District Court of Uinta County to recover a warm air furnace or “heater,” as it is designated in its petition, which it had theretofore installed in the basement of a dwelling house in Evanston, Wyoming. Joseph Bird, at first the mortgagee and ultimately the owner of the premises, defended the action. Judgment was given that the plaintiff take nothing in the proceeding and that “the defendant is entitled to the possession and property in” said furnace.
