This is an action to recover damages for injuries sustained by plaintiff when struck by a streetcar operated by the defendant, The Peoples Railway Company.

In the Common Pleas Court, the plaintiff recovered a judgment in the sum of $1,000 upon a special verdict returned by the jury, but, on appeal to the Court of Appeals of Montgomery county, this judgment was reversed and final judgment was entered in favor of the defendant on the ground that the trial court erred in refusing to grant the motion of the defendant for a directed verdict.
