Defendant appeals his conviction for theft in the first degree. ORS 164.055. He moved in this court for a new trial under ORS 19.130(3), because a portion of the court reporter’s notes were destroyed. We reverse and remand for a new trial.
Defendant was charged with theft of an automobile in an indictment returned October 17, 1974. Trial began on Wednesday, March 19, 1975, and recessed on Friday, March 21, for a three-day weekend.
