MEMORANDUM OPINION AND ORDER

For several years now, plaintiff Richard P. Day has been trying to recover an $1,850 loan he made to debtor Michael J. Klingler. After Klingler’s chapter 7 bankruptcy halted Day’s collection efforts in state court, Day filed an adversary proceeding (the “first adversary”) in the bankruptcy seeking a determination that the debt was nondischargeable.
