MEMORANDUM OPINION AND ORDER

This action is currently before the Court on Plaintiff’s motion for a preliminary injunction. Jurisdiction is predicated upon 12 U.S.C. § 3416, 1 and 28 U.S.C. § 1331. 2 Plaintiffs seek injunctive relief against the Defendant Securities & Exchange Commission (“SEC”) to enjoin the agency from violating Plaintiffs’ rights under the Right to Financial Privacy Act, 12 U.S.C. §§ 3401, et seq.
