The plaintiff, Dianna L. Graham, (“Graham”), seeks compensatory and punitive damages from the defendants, Island Creek Coal Company, (“Island Creek”), and Consolidation Coal Company, (“Con-sol”), for damage to certain real property she owns in Buchanan County, Virginia. 1 Graham claims that improvements on the property have been damaged as a result of the defendants’ underground coal mining operations.
