MEMORANDUM OPINION AND ORDER

FRANK, District Judge.

Introduction

Plaintiff Sheila Rheineck sued her employer, Hutchinson Technology Incorporated (“HTI”) for sexual harassment and retaliation under Title VII. The Plaintiff also set forth several common law tort claims as well as a claim for breach of contract, all arising out of the circulation in the workplace of a picture of a topless woman that resembled the Plaintiff and the em ployer’s alleged promise to announce to its employees that the picture was not of the Plaintiff.
