This is an appeal from an order of the General Term of the Murine Court reversing a judgment entered upon the verdict of a jury in the Marine Court of .the city of New York. The action was brought to recover damages to personal property caused by the falling of a building of which the defendant was the owner. The plaintiff resided with his family upon the top floor of the premises in question.
