— Appellant was charged by information with the crime of negligent homicide under RCW 46.56.040. The charging portion of the information reads as follows:
“That the said Charles E. Baker in the County of Pierce, in the State of Washington, on or about the 13th day of September, Nineteen Hundred and Fifty-eight did then and there being unlawfully and feloniously operate a motor vehicle in a reckless manner with disregard for the safety of others, and while under the influence of or affected by the use of intoxicating liquor, and while so operating said vehicle and being in physical control…
