This is an appeal from the decree of a judge of the first circuit, sitting at chambers, in equity, in a suit for legacy.

Mary E. Foster, a citizen and resident of this Territory, died in Honolulu on December 19, 1930, leaving a large estate for distribution under her last will, made on December 22, 1926, and a codicil thereto made June 17, 1930. The will and codicil were together admitted to probate in the first circuit on February 11, 1931.
