MEMORANDUM OF DECISION AND ORDER
SPATT, District Judge.
This cases arises from allegations that the Defendants U.S. Nonwovens Corp. (“Non-wovens”) Samuel Mehdizadeh a/k/a Solomon Mehdizadeh, Shervin Mehdizadeh Mehdiza-deh, and Rody Mehdizadeh (collectively, the “Defendants”) failed to pay their employees timely wages, overtime, and spread of hours wages in violation of the Fair Labor Standards Act, 29 U.S.C. § 201 et seq. (“FLSA”), and the New York Labor Law § 650 et seq. (“NYLL”).
