This is an appeal from a judgment in Todd County District Court after denial of the plaintiff’s motion for a new trial following verdict for the defendant in a wrongful death action. The principal ground upon which the plaintiff relies for a reversal is that the trial court committed prejudicial error by failing to instruct the jury with reference to forfeiture of right-of-way under M.
