The plaintiff in erroi*s together with Christiana Schoeffler, was indicted at the April term, 1854, of the Outagamie Circuit Court, for the murder of his wife, Frederika Schoeffler, and was tried at a special term of said court, held pursuant to the statute, in May following. The trial resulted in a verdict of guilty as to both defendants. A new trial was moved in behalf of the prisoners, which was granted as to Christiana, and denied as to the present plaintiff in error.
