October 7, 1943, appellants and re spondent entered into a written agreement for the sale and purchase of certain real property, together with all water rights, in Filer townsite, Twin Falls County, Idaho, at the agreed price of $1500.00, $200.00 payable upon the execution of the contract, receipt of which was acknowledged, and the balance on delivery of a good and sufficient warranty deed and an abstract of the property showing a marketable title, free and clear of all liens and encumbrances, except taxes, assessments, insurance and water maintenance charges for the year 1944 and thereafter.…
