Paul H. Altrocchi and James F. Downey, III, by their amended complaint sought to recover a judgment declaring that the defendant, William P. Hammond, III, who was an insurance broker, was the insurer of Altrocchi’s liability arising out of an automobile accident which occurred on October 10, 1954, or, in the alternative, that the defendant, Fidelity and Casualty Company of New York, be declared the insurer of the plaintiff, Altrocchi.
