Marilyn M. Marshall appeals from a final order entered in the United States District Court 1 for the District of South Dakota dismissing her tort action against Mikel Warwick for insufficient service of process. Marshall v. Warwick, No. CIV 97-3002 (D.S.D. Oct. 23, 1997) (Order) (hereinafter “slip op”).
