This case is before the court after argument on defendant’s motion to dismiss Count II of plaintiffs complaint for lack of subject matter jurisdiction and for summary judgment on Count I. Plaintiff claims that the Government’s cancellation of an Invitation for Bids relating to the printing of United States patents was arbitrary and capricious, thus entitling plaintiff to bid preparation and related costs.
