Plaintiff, Edward J. Shields, appeals as of right the trial court’s order dismissing his third-party complaint to recover response activity costs for environmental contamination. The parties first addressed the timeliness of this action in the context of Shell Oil Company’s motion for summary disposition pursuant to MCR 2.116(C)(7), which the trial court granted.
