In 1981, the International Union, United Automobile, Aerospace & Agricultural Implement Workers of America (“UAW”) and eleven named plaintiffs filed suit in the District Court challenging worker eligibility guidelines promulgated by the Secretary of Labor for the Trade Readjustment Allowance (“TRA”) program of the Trade Act of 1974 (the “Act” or “Trade Act”). 19 U.S.C. § 2101 et seq.
