—Appeal from a modified judgment of Supreme Court, Erie County (Fahey, J.), entered April 2, 2002, which modified the judgment entered August 11, 2000, and awarded judgment in favor of plaintiff 10 Park Square Associates, Inc. and in the amount of $190,351.19.
It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously modified on the law by vacating that part awarding plaintiff 10 Park Square Associates, Inc. $71,000 for the actual cash value of the building with interest and as modified the modified judgment is affirmed without costs, and the matter is…
