HARPER, Judge.
Appellant was prosecuted and convicted of murder in the first degree, and his punishment assessed at life imprisonment in the penitentiary.
The State’s evidence would show that appellant was running a restaurant at Temule, and had as one of his waiters Jett Haley, a woman whose virtue was questionable, to say the least. Prior to the time she went to work for appellant as a waiter, she admits she was boarding and staying with a woman who was known as a prostitute.
