HARPER, Judge.
Appellant was indicted, charged with murder, and when tried was convicted of murder in the second degree and his punishment assessed at twenty years confinement in the penitentiary.
There are a number of bills of exceptions in the record, some of which we can not consider, the court rejecting them, stating as a reason for refusing them: “The bill is disapproved for the reason that the supposed error mentioned therein has never been called to the attention of the court, either at the time of the trial or in the motion for a new trial, or in defendant’s amended motion .for a new…
