This action was instituted to establish a debt alleged to have been due and owing to the plaintiff by one George K. Breintnall, now deceased.

Some precursory narrative of the material facts alleged in the complaint and substantiated by affidavit is necessary to exhibit the controversial issues to be considered and deter*130mined. Concisely stated, the complaint and supporting affidavit disclose that on June 10th, 1911, the plaintiff loaned to George K. Breintnall the sum of $250,000.
