This suit was commenced in the United States Court for the Western District of Indian Territory, by bill in equity, for a declaration of trust, for an accounting, and the cancellation of certain deeds. The cause after statehood was transferred to the superior court of Muskogee county, and on January 9, 1911, was, by order of court, on agreement of the parties, referred to Hon. Charles A.
