Appeal .from Wayne District Court. — Hon. H. K. Evans, Judge. Action to enjoin the defendants from cutting a certain pipe connecting plaintiffs’ mine with a pond upon defendants’ land, through which water was furnished to the plaintiffs for the operation of the mine. The opinion states the facts. Decree for the plaintiffs. Defendants appeal.

This action is brought by the plaintiffs to enjoin the defendants from cutting a water pipe leading from a pond on the land owned by the defendant Covil to a coal mine on plaintiffs’ land, and from interfering with plaintiffs’ right to pipe water from said pond for use on plaintiffs ’ land..
