OPINION & ORDER

LEISURE, District Judge:

Plaintiff Howard Kelly (“Kelly”) commenced this action on July 11, 1984 against the City of New York (“City”), the Correction Department of the City of New York (“Correction Department”) and Jose Quinones (“Quinones”) seeking damages for an alleged violation of his civil rights under color of state law. Defendant Quinones is a Corrections Officer in the Correction Department of New York City, but the City is not defending Quinones in this case.
