McLAUGHLIN, Circuit Judge.

This is an appeal from a judgment of the district court sitting without a jury wherein Roth, the appellant, was allowed a partial recovery of his claims against Maryland Casualty Company, the appel-lee. 1 2 The basis of jurisdiction is diversity of citizenship.

Roth, trading as Roth & Company, a securities broker in Allentown, Pennsylvania, during all times here material was insured by appellee under an indemnity bond of a type known as a broker’s blanket bond.
