Plaintiff Ashland Regional Medical Center (“Ashland”) seeks judicial review of a final determination of the Provider Reimbursement Review Board (“PRRB” or the “Board”) of the Health Care Financing Administration (“HCFA”) denying jurisdiction over Ashland’s appeals from the Blue Cross of Western Pennsylvania’s (a fiscal intermediary) decision refusing to reopen prior years’ Medicare reimbursement claims to allow retroactive recognition of Ashland’s status as a Medicare Dependent Small Rural Hospital (“MDH”).
