I dissent from the denial of en banc hearing because I believe the Suspension Clause, as construed by the Supreme Court in Boumediene v. Bush, 553 U.S. 723, 128 S.Ct. 2229, 171 L.Ed.2d 41 (2008), entitles detainees at Guantanamo Bay to notice of transfers that will take them beyond the reach of the writ of habeas corpus. The petitioners ask us to reexamine our ruling to the contrary in Kiyemba v. Obama {Kiyemba II), 561 F.3d 509 (D.C.Cir.2009). We should oblige.
