On May 1, 1937, the Pennsylvania Liquor Control Board issued to the Penelope Club, for premises in the city of Pittsburgh, a Club Liquor License under the provisions of Section 401 of the “Pennsylvania Liquor Control Act” of July 18, 1935, P. L. 1246, No. 399. As required by Section 406, the applicant filed with the board a surety bond, payable to the Commonwealth of Pennsylvania, in the amount of $2,000 and containing a warrant of attorney to confess judgment, upon which Continental Casualty Company, appellant herein, became surety.
