Harold E. Gray, plaintiff--respondent, was found on the right of way of the St. Louis-San Francisco'Eailway Company near Fordland, Missouri, on August 3, 1950: He was removed to O’Eeilly .Veterans’ Administration Hospital- in Springfield. He’ brought an action against defendant-appellant Eailway for $100,000 actual and $25,000 punitive damages. The jury returned a verdict for defendant-appellant. The trial court granted a new trial for the assigned reason that it erred in excluding the O ’Eeilly Hospital record pertaining to respondent. The Eailway appealed from the order granting…
