The plaintiff is and has been at all times here material a resident of this Commonwealth. The defendant is a foreign corporation, having no agent nor place of business within the Commonwealth. The action is in contract to recover the value of a car of hay alleged to have been sold wrongfully and against the rights of the plaintiff by the defendant to pay freight and demurrage charges. The defendant appeared specially and filed a motion to dismiss the action on the ground that the court had no jurisdiction over it.
