MEMORANDUM OPINION AND ORDER MODIFYING JUDGMENT AND COMMITMENT
EISELE, District Judge.
Before the Court is defendant Troy Lee Warner’s Motion Under 28 U.S.C. § 2255 to Vacate, Set Aside, or Correct Sentence by a Person in Federal Custody, filed on March 21, 1996. Defendant is currently incarcerat ed at the federal correctional institution at Elgin Air Force Base, Florida. The Court reviewed Warner’s motion and ordered the Government to respond, see 28 U.S.C. § 2255, Rule 4(b), and the Government filed its response on April 15, 1996. This motion is thus ripe for disposition.
