Plaintiff, Walter Johnson, appeals from the district court’s order denying summary judgment to Plaintiff and granting summary judgment to Defendant, the Economic Development Corporation of the County of Oakland (“Oakland EDC”), on Plaintiffs claim alleging that Defendant violated the First Amendment Establishment Clause by issuing tax-exempt revenue bonds to finance the construction of buildings at the Academy of the Sacred Heart (the “Academy”), a Catholic elementary and secondary school.
