Plaintiff-appellant American Eagle Insurance Company (“American Eagle”) filed this diversity action in the Eastern District of Arkansas seeking a. declaration that John H. Thompson was not covered under an aviation insurance policy issued by it to Arkansas Aircraft Inc. (“Arkansas Air”). American Eagle sought a determination that it had no duty to defend or indemnify Thompson in two underlying state tort actions in Georgia.
