On the 14th day of March, 1923, the defendant in error, F. L. Simmons, as the father and next of kin of Bonnie Simmons, deceased, brought his action, as plaintiff, in the district court of Marshall county, against the plaintiff in error, St. Louis-San Francisco Railway Company, and the defendant in error W. A. Yoacum, as defendants, to recover damages for the alleged wrongful death of the said Bonnie Simmons at a public railway crossing near Ravia, Okla.
