The essential facts in this case are substantially as follows: Defendant in error is a railway company, having one of its railway shops in the city of Chickasha, in this state. Plaintiff in error, who was plaintiff in the court below, was a common .laborer in the employment of the defendant in error, Chicago, Rock Island & Pacific Railway Company. His labors were performed, in the shops of said company. One Robert Hall, who was codefendant in the action in the trial court, was also in the employment of the railway company, and held the title of apprentice boilermaker foreman. On the…
