This is a proceeding to review an award of the Industrial Commission of Utah. The plaintiff Bell Sample Shoe Company is an employer within the terms of the Utah Industrial Act (Comp. Laws 1917, §§ 3061-3165), and defendant Hayes was its employee. The plaintiff Fidelity & Guaranty Company carried the insurance. On January 8, 1926, defendant Hayes, by letter addressed to the commission, represented that he had sustained an injury in said employment on December 23, 1925, and made application for such compensation as he might be entitled to under the Industrial Act.
