ROGERS, Justice.

Fred Graffam was convicted of the murder of Mary Campbell and sentenced to death by electrocution. His appeal is based upon sixteen bills of exception reserved in the trial court and an assignment of errors filed in this court.

Defendant’s first complaint in his assignment of errors is that the trial judge assumed the role of prosecuting attorney, assisting the district attorney in examining the witnesses for the State, and, in many instances, instructing him how to proceed.
