Appeal from an order of the Supreme Court (Kahn, J.), entered May 20, 1992 in Albany County, which, inter alia, granted plaintiffs’ motion for partial summary judgment on the issue of liability and denied defendants’ cross motion for summary judgment on their third-party claim for indemnity.
Plaintiffs commenced this action to recover for injuries sustained by plaintiff Joseph Dennis (hereinafter plaintiff) when he fell from a ladder while installing sheetrock for his employer, third-party defendant, on a building project in Albany County.
