OPINION

CALEB M. WRIGHT, Chief Judge.

This is a criminal case arising under Title 18, U.S.C. § 1341 wherein the various individual defendants and the single corporate defendant are charged with having conspired to use the United States Mails to defraud.1 Motions to dismiss *350have been filed by defendants Ruskin, Benston, Yanowski, Rosenfeld and Snyder and the Government has moved that the cause be set down for trial.
